Mr. Geovanni Bracket, President of COLA (Citizens Organized for Liberty through Action), was today in Belmopan along with two other executive members of the organization.
Their sole purpose was to to file a private prosecution against Elvin Penner as was Prime Minister Barrow’s suggested option for Belizeans frustrated with the lack of legal action against Penner.
Mr. Geovanni Bracket gives details of the case they presented to the court this morning.
“So, Emmanuel, what happened here at the magistrate’s court in Belmopan, three of us, myself, Jihaad McLaren and Rufus, we came here to file a private prosecution against Elvin Penner for two alleged accounts of Criminal Offense; one for making a statement which he knew to be false in a material particular, which, in a Nationality certificate for the purpose of procuring the issue of a passport to a South Korean national Wong Hong Kim contrary to Section 22 of the Belize Nationality and Passport Act 161 of the laws of Belize. The 2nd offense is for vouching the fitness of an applicant Wong Hong Kim to receiving a Belizean Passport, contrary to Section 31 (h) of the Passport Act Chapter 164 of the Laws of Belize, Revised Edition”.
As you may well be aware, PUP is also putting pressure on the Commissioner of Police through a writ of mandamus to press charges against Elvin Penner. With the six months limitation, COLA says there is need for an urgent prosecution.
Mr. Geovanni Bracket: “This was another avenue that we had limited task to exhaust. So, in case, that writ of mandamus, we are here to run a parallel thing per angle and exhaust this avenue as well”.
“What if this fails like the Offshore Drilling petition, like the recall mechanism…what I am saying that if this fails, the Prime Minister fails; this was his recommendation to the citizens of Belize. The Prime Minister will be caught telling a blatant lie and misleading the people own a destructive road if this should fail, my bradda”.
COLA says that there are a couple of lawyers who are interested in carrying out this private prosecution. Nevertheless, Brackett says there is still a possibility that these two different avenues, one from the PUP and one from COLA, could suffer the same failure of the Recall Mechanism.
The court date has been set for March 27th at 9:00 am at the Magistrate’s Court in Belmopan.
