25 year old Malcolm Myers was found guilty of “use of deadly mans of harm” for an incident in which he shot Trevor Yarde in his leg. His trial began today in the court room of Chief Magistrate Ann Marie Smith. Myers is accused of shooting 20 year old Belize City resident Trevor Yarde on Freetown Road in Belize City on November 4, 2015 at about 2:15 a.m. Initially, Myers was charged with three indictable offenses: attempted murder, dangerous harm and use of deadly means of harm, but instruction from the DPP ordered the court to drop the first two charges and to proceed with use of deadly means of harm summarily, which is why he was tried at the lower court. Yarde, who has fully recovered from his injury, took the stand this morning and identified Malcolm Myers as the person who shot him. Myers, for his part, said t was not him as he was at home playing video games with his cousin at the time of the incident. That alibi could not be established and the Magistrate found Myers guilty. In court, while the shooting victim was still present, Myers was asked to apologize to him for shooting him but Myers refused. He was remanded to the Belize Central Prison until June 23, when the Chief Magistrate, Anne Marie Smith will hand down her sentence.
